Personal Injury Law

To win a personal injury claim in  Massachusetts, you must show that another party’s careless or reckless  actions caused your injury. Victims (plaintiffs) may file claims against  the responsible parties (defendants) under several legal principles:

  • Negligence: Failure to use reasonable care resulting in injury. Even unintentional  acts can make a person liable. Insurance coverage often applies through  auto, homeowner’s, or general liability policies.
  • Strict Liability: Applies mainly to defective products and dog bites. Manufacturers,  suppliers, or owners may be responsible regardless of intent.
  • Intentional or Reckless Misconduct: Deliberate or malicious acts causing injury or death. Families may recover punitive damages in wrongful death cases.
  • Comparative Negligence: If an injured person shares fault, their compensation is reduced based on their degree of responsibility.

Damages may include medical expenses, lost wages, pain and suffering, scarring, disability, or loss of companionship. Because these cases are complex and emotional, consult Xifaras Law before signing any release or settlement.

Workers' Compensation

If you’re injured on the job, you may be entitled to workers’ compensation benefits—but filing a claim or appealing a denial can be confusing. In some cases, a third party (other than your employer) may share responsibility for your injury, and you could also qualify for Social Security disability benefits.

Xifaras Law has extensive experience with work-related injuries, including construction accidents, slip and falls, repetitive stress injuries, back injuries, and carpal tunnel syndrome. We fight to protect your rights and ensure you receive every benefit you’re entitled to under the law.
